{"id":27083,"date":"2024-06-19T14:14:32","date_gmt":"2024-06-19T14:14:32","guid":{"rendered":"https:\/\/z6frttwr.ordoiuris.io\/aktualnosc\/the-perpetrators-of-the-constitutional-crisis-will-face-consequences-a-declaration-by-the-legal-community\/"},"modified":"2025-10-29T10:39:49","modified_gmt":"2025-10-29T09:39:49","slug":"the-perpetrators-of-the-constitutional-crisis-will-face-consequences-a-declaration-by-the-legal-community","status":"publish","type":"informacje","link":"https:\/\/ordoiuris.pl\/en\/press-newsdesk\/the-perpetrators-of-the-constitutional-crisis-will-face-consequences-a-declaration-by-the-legal-community\/","title":{"rendered":"\u201cThe perpetrators of the constitutional crisis will face consequences\u201d \u2013 A Declaration by the Legal Community"},"content":{"rendered":"<p class=\"text-align-justify\"><strong>\u00b7 A meeting of representatives of the Polish legal community took place in the Collegium Intermarium\u2019s auditorium, where the participants adopted a declaration of agreement on June 15.<\/strong><\/p>\n<p class=\"text-align-justify\"><strong>\u00b7 Its signatories are opposed to the current authorities\u2019 disregard for the constitutional principles of the Republic of Poland through, among other things, questioning the independence of the courts and the independence of judges, as well as by taking over the prosecutors\u2019 offices and the public media.<\/strong><\/p>\n<p class=\"text-align-justify\"><strong>\u00b7 The meeting\u2019s participants pledged to work together to rebuild the judiciary and respect for the rule of law.<\/strong><\/p>\n<p class=\"text-align-justify\"><strong>\u00b7 They also promised that they would make efforts to hold accountable those responsible for the current authorities\u2019 unlawful actions.<\/strong><\/p>\n<p class=\"text-align-justify\"><strong>\u00b7 The declaration was signed by Ordo Iuris, Sovereignty College, Collegium Intermarium, the Lawyers for Poland Association (Stowarzyszenie Prawnicy dla Polski), the All-Poland Association of Judges of the Republic of Poland (Og\u00f3lnopolskie Zrzeszenie S\u0119dziowie RP), the Ad Vocem Association of Prosecutors (Stowarzyszenie Prokurator\u00f3w Ad Vocem), the Warsaw Seminar on the Axiology of Administration, and the Institute for Justice Foundation.<\/strong><\/p>\n<p class=\"text-align-justify\">Representatives of the legal community met in the Collegium Intermarium\u2019s auditorium to discuss cooperation in addressing the ongoing constitutional crisis in Poland. Dozens of legal professionals \u2013 judges, prosecutors, advocates, legal advisers, bailiffs, and notaries \u2013 discussed the destructive impact of the Polish government\u2019s actions on the judiciary as well as those citizens who are involved with the legal system come into contact with it. The meeting concluded with the ceremonial signing of a declaration of cooperation.<\/p>\n<p class=\"text-align-justify\">The signatories of the declaration point to <a href=\"https:\/\/brusselssignal.eu\/2024\/06\/eu-liberals-crushing-the-law-in-poland-by-transitional-justice\/\">the ongoing constitutional crisis in Poland<\/a>, \u201cwhich includes the questioning by the executive and legislative authorities of the principles of the independence of the courts and judges as well as those the rule of law, which constitute the foundations for the functioning of a democratic state based on law\u201d.<\/p>\n<p class=\"text-align-justify\">The above-named organisations disagree with the actions taken by the government of Donald Tusk, which are striking at the very foundations of Poland\u2019s political system.<\/p>\n<p class=\"text-align-justify\">\u201cWe oppose the distinctions being drawn in terms of some judges\u2019 status, the illegal takeover of the public media the National Public Prosecutor\u2019s Office alongside lower-rank public prosecutors\u2019 offices and the presidents of the courts, including the courts of appeal. We are also concerned about the projects being promoted by the government to politically remodel and limit the democratic legitimacy of the National Council of the Judiciary, the changes to the Supreme Court system, as well as the announced dispute over the Constitutional Tribunal\u2019s jurisprudence, which enjoys the status of \u2018the last word\u2019 in light of the Constitution\u201d, the declaration stressed.<\/p>\n<p class=\"text-align-justify\">The meeting\u2019s participants announced their intention to work together to rebuild the judiciary. They also expressed their readiness to monitor those cases which reflect the destruction of the Republic of Poland\u2019s constitutional foundations and to hold those responsible for it accountable.<\/p>\n<p class=\"text-align-justify\">\u201cWe declare that we shall oppose all acts of lawlessness, condemning the perpetrators and their deeds, and we will undertake to take all measures to call to account those who, while using the slogan of \u2018restoring the rule of law\u2019, are violating the Constitution of the Republic of Poland as well as those legal customs inherent in the European cultural tradition.<\/p>\n<p class=\"text-align-justify\">The signatories are likewise inviting other legal milieus to cooperate with them.<\/p>\n<p class=\"text-align-justify\">\u201cWe appeal to those judges, advocates, prosecutors, legal advisers, and bailiffs, as well as those notaries who wish to serve a law-abiding homeland, where equality before the law, justice, and human dignity shall receive appropriate legal protection. There is a place for you among us\u201d, the declaration reads.<\/p>\n<p class=\"text-align-justify\">The meeting\u2019s participants are opposed to the interpretation of the legal provisions that have been propagated by the current government, which runs contrary to the principles of the rule of law.<\/p>\n<p class=\"text-align-justify\">\u201cIt is time to express firm support for the objective constitutional order. It is time to categorically reject the legal relativism which is encapsulated in the Prime Minister\u2019s memorable words about \u2018the law as we understand it\u2019\u201d, noted the
