Court in Warsaw ordered the Warsaw-\u015ar\u00f3dmie\u015bcie District Prosecutor\u2019s Office to open a preliminary investigation into the Abotak establishment, which presents itself as an abortion \u201cclinic.\u201d It was opened in Warsaw on March 8, 2025 next to the Polish Sejm, with the tacit approval of the government of Donald Tusk, which has been ensuring it police protection against pro-life, pro-rule-of-law protests in its vicinity.<\/p>\n\n\n\n<p>Two days after its opening, the Ordo Iuris Institute <a href=\"https:\/\/ordoiuris.pl\/en\/press-newsdesk\/an-abortion-clinic-in-warsaw-ordo-iuris-notifies-the-prosecutors-office\/\">filed a complaint with the prosecutor\u2019s office<\/a> regarding the establishment\u2019s operations. It was specifically directed against three pro-abortion activists\u2014Justyna Wydrzy\u0144ska, Natalia Broniarczyk, and Kinga Jedli\u0144ska. Ordo Iuris reported a possible violation by them of Article 152 of Poland\u2019s Criminal Code (termination of pregnancy in breach of statutory provisions) and Article 124 of the Pharmaceutical Law Act (placing a medicinal product on the market without authorization). The Warsaw-\u015ar\u00f3dmie\u015bcie District Prosecutor\u2019s Office <a href=\"https:\/\/ordoiuris.pl\/informacje-prasowe\/prokuratura-nie-chce-scigac-aborcyjnej-przychodni-w-warszawie\/\">nevertheless refused to initiate proceedings<\/a>, in line with the Tusk government\u2019s policy <a href=\"https:\/\/ordoiuris.pl\/en\/press-newsdesk\/polands-ruling-coalition-of-pro-eu-left-liberals-want-to-make-abortion-on-demand-available-in-opposition-to-the-law-and-the-constitution\/\">of making abortion available in Poland<\/a> despite the law and the Constitution, which unequivocally forbid any form of abortion on demand.<\/p>\n\n\n\n<p>The Ordo Iuris Institute decided to notify the prosecutor\u2019s office because the activists, during press conferences and in interviews, confirmed that medication abortions would be performed at the facility. Justyna Wydrzy\u0144ska was previously <a href=\"https:\/\/ordoiuris.pl\/en\/press-newsdesk\/justyna-wydrzynska-convicted-of-aiding-and-abetting-a-medical-abortion\/\" target=\"_blank\" rel=\"noreferrer noopener\">convicted for providing abortion pills<\/a> to a pregnant woman expecting twins, although the Court of Appeal in Warsaw later <a href=\"https:\/\/ordoiuris.pl\/en\/press-newsdesk\/the-appeal-against-pro-abortion-activist-justyna-wydrzynskas-conviction-handing-out-abortion-pills-is-like-offering-a-cup-of-soup\/\" target=\"_blank\" rel=\"noreferrer noopener\">remanded the case for reconsideration<\/a>.<\/p>\n\n\n\n<p>On January 23, the Regional Court in Warsaw set aside the decision by the prosecutor\u2019s office refusing to initiate proceedings against the Abotak abortion activists. The court stated that the decision of the prosecutor\u2019s office was clearly premature and based on incomplete evidence, as well as superficial and ill-considered. This means that the prosecutor\u2019s office, thanks to Ordo Iuris\u2019 efforts and despite the Polish government\u2019s unlawful conduct, will have to conduct a preliminary investigation in this
