The candidates were Sylwia Gregorczyk-Abram, nominated by deputies of the Civic Coalition and the Left (<a href=\"https:\/\/www.sejm.gov.pl\/sejm10.nsf\/PrzebiegProc.xsp?nr=2735\" target=\"_blank\" rel=\"noreferrer noopener\">Sejm paper no. 2735<\/a>), and Adam Borowski, nominated by deputies of Law and Justice (<a href=\"https:\/\/www.sejm.gov.pl\/sejm10.nsf\/PrzebiegProc.xsp?nr=2734\" target=\"_blank\" rel=\"noreferrer noopener\">Sejm paper no. 2734<\/a>). A <a href=\"https:\/\/www.sejm.gov.pl\/sejm10.nsf\/transmisje_arch.xsp#0A3AC79F823F443CC1258E2F002E948E\" target=\"_blank\" rel=\"noreferrer noopener\">full recording of the event<\/a>, which lasted more than seven hours in total, is available on the Sejm\u2019s website. Representatives of several dozen non-governmental organizations took part in the hearing, including a representative of the Ordo Iuris Institute for Legal Culture Foundation \u2013 attorney Nikodem Bernaciak.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Ordo Iuris representative asked both candidates two questions (19:09:15\u201319:11:06):<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>\u201cWill you stand guard over human and civil freedoms and rights also at the prenatal stage of development \u2013 I mean here children conceived but not yet born? On this point we have a uniform line of case law of the Constitutional Tribunal. These are, above all, the ruling of May 28, 1997 (<a href=\"https:\/\/orka.sejm.gov.pl\/Rejestrd.nsf\/0\/C320F39D46F0555AC1256594004553DE\/\" target=\"_blank\" rel=\"noreferrer noopener\">case K 26\/96<\/a>), and the judgment of October 22, 2020 (<a href=\"https:\/\/trybunal.gov.pl\/s\/k-1-20\" target=\"_blank\" rel=\"noreferrer noopener\">case K 1\/20<\/a>), in which the Tribunal held that \u201chuman life is subject to legal protection, including in the prenatal phase, and the legal subjectivity of the child is inextricably linked to the dignity vested in it. It is therefore possible for one of the conflicting constitutional goods to lie on the side of the child in the period of life before birth.\u201d With reference to this line of the Constitutional Tribunal\u2019s case law, will you stand guard over human freedoms and rights also at the prenatal stage of development?<\/li>\n\n\n\n<li>Will you stand guard over the freedoms and rights also of those citizens who place the provisions of the Polish Constitution above the provisions of primary European Union law as interpreted by the EU Court of Justice? For example, in just two weeks, on July 28, the Constitutional Tribunal is due to deliberate on the incompatibility with the Polish Constitution of the <a href=\"https:\/\/isap.sejm.gov.pl\/isap.nsf\/DocDetails.xsp?id=WDU20260000667\" target=\"_blank\" rel=\"noreferrer noopener\">regulation of the Ministry of Digital Affairs<\/a> which \u2013 following the Luxembourg court \u2013 makes it possible to enter two persons of the same sex in a marriage record (<a href=\"https:\/\/trybunal.gov.pl\/postepowanie-i-orzeczenia\/wokanda\/art\/zmiana-rozporzadzenia-ministra-cyfryzacji-w-zakresie-w-jakim-wprowadza-wzory-dokumentow-przeznaczonych-do-sporzadzania-i-wydawania-odpisow-aktow-malzenstwa-dotyczacych-malzenstw-zawartych-za-granica-1\" target=\"_blank\" rel=\"noreferrer noopener\">case U 2\/26<\/a>). Assuming that the Tribunal rules those provisions unconstitutional, and a superior nevertheless orders a subordinate to comply with them, and the subordinate refuses \u2013 will you stand guard over the freedoms and rights of the citizens who, in such a situation, choose fidelity to the provisions of the Polish Constitution?\u201d<\/li>\n<\/ol>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>European court rulings above Poland\u2019s Constitution<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The candidate nominated by Law and Justice did not address these questions directly, whereas the candidate of the governing coalition (who, given the arithmetic of the Sejm, has the greatest chance of assuming the office of Commissioner), referring to the questions concerning the protection of conceived life, announced that \u201cas for the assessment of the ruling of October 22, 2020, it has, after all, already been assessed by the European Court of Human Rights in the cases of <a href=\"https:\/\/hudoc.echr.coe.int\/fre?i=001-229424\" target=\"_blank\" rel=\"noreferrer noopener\">M.L. v. Poland [judgment of December 14, 2023]<\/a> and <a href=\"https:\/\/hudoc.echr.coe.int\/eng?i=001-245820\" target=\"_blank\" rel=\"noreferrer noopener\">A.R. v. Poland [judgment of November 13, 2025]<\/a>. [\u2026] And that binds the Commissioner\u201d (broadcast excerpt, 18:35:49\u201318:36:34), and also that \u201cwhen we trace the discussion in the National Assembly and the referendum campaign that preceded the adoption of the Constitution, there is no doubt that, among the drafters, deliberately and intentionally, <strong>this provision [Article 38 of the Polish Constitution] omits legal protection of the prenatal period<\/strong>. [\u2026] In my view, we can have a debate \u2013 though it is already a very technical legal debate \u2013 as to whether the 1997 ruling has the character of a derogating judgment or not. But I believe that it assessed, above all, the social ground for the admissibility of terminating a pregnancy, and that was the essence of that ruling. <strong>The Commissioner is bound by all judgments of the European Court of Human Rights<\/strong>\u201d (broadcast excerpt, 19:31:18\u201319:32:31).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As regards the imposition on Poland by the CJEU (and, on the employees of civil registry offices, by the government) of the transcription of same-sex unions, the candidate of the left-wing parties forming Donald Tusk\u2019s government stated: \u201cAs for the question concerning the review by the Constitutional Tribunal of whether the regulation of May 22, intended to implement the judgments in <a href=\"https:\/\/hudoc.echr.coe.int\/?i=001-235976\" target=\"_blank\" rel=\"noreferrer noopener\">Formela v. Poland [of September 19, 2024]<\/a> and <a href=\"https:\/\/hudoc.echr.coe.int\/eng?i=001-229391\" target=\"_blank\" rel=\"noreferrer noopener\">Przybyszewska v. Poland [of December 12, 2023]<\/a> \u2013 of course this binds us, and <strong>public authorities should comply<\/strong>. If such a ruling is handed down, then \u2013 if I have the opportunity \u2013 <strong>I will of course look into the composition of the panel in which it was issued<\/strong>, but my opinion of the Constitutional Tribunal is also well known. Nor can it be that it serves as a kind of skeleton key for eliminating inconvenient rulings of the European courts, because that, after all, was the subject of the European Commission\u2019s complaint, and those proceedings concluded on December 18, 2025 [<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX:62023CJ0448\">with the judgment in case C-448\/23<\/a>]\u201d (broadcast excerpt, 19:33:14\u201319:34:33).<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Ordo Iuris opinions and the ECtHR\u2019s ideological activism<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">In all four sets of proceedings before the European Court of Human Rights cited by the candidate for Commissioner for Human Rights, the Ordo Iuris Institute submitted an <em>amicus curiae<\/em> opinion, pointing to the incompatibility with the Polish Constitution of any regulations permitting either eugenic abortion or the institutionalization of same-sex unions \u2013 these were the <a href=\"https:\/\/ordoiuris.pl\/informacje-prasowe\/trybunal-w-strasburgu-polska-musi-prawnie-uznawac-konkubinaty-jednoplciowe\/\" target=\"_blank\" rel=\"noreferrer noopener\">brief in Przybyszewska v. Poland<\/a> (December 12, 2023), the <a href=\"https:\/\/ordoiuris.pl\/informacje-prasowe\/trybunal-w-strasburgu-wyrok-zakazujacy-aborcji-eugenicznej-wydany-nielegalnie\/\" target=\"_blank\" rel=\"noreferrer noopener\">brief in M.L. v. Poland<\/a> (December 14, 2023), the <a href=\"https:\/\/ordoiuris.pl\/informacje-prasowe\/wyrok-etpc-niezgodny-z-polska-konstytucja-trybunal-domaga-sie-prawnego-uznania-konkubinatow-jednoplciowych\/\" target=\"_blank\" rel=\"noreferrer noopener\">brief in Formela v. Poland<\/a> (September 19, 2024), and the <a href=\"https:\/\/ordoiuris.pl\/en\/analyses\/the-echr-ruling-does-not-challenge-the-ban-on-eugenic-abortion-only-the-way-it-was-introduced\/\" target=\"_blank\" rel=\"noreferrer noopener\">brief in A.R. v. Poland<\/a> (November 13, 2025). Despite this, in each of these cases the ECtHR judges displayed ideological activism, imposing on Poland outcomes contrary not only to the Constitution but also to the order of natural law. The problem is not the original wording of the European Convention on Human Rights itself, but precisely its ideological interpretation by today\u2019s ideologues in robes. That is why <a href=\"https:\/\/x.com\/jerzKwasniewski\/status\/1853122368220393894\" target=\"_blank\" rel=\"noreferrer noopener\">the president of Ordo Iuris signaled as early as 2024<\/a> that \u201cmany arguments speak in favor of radically limiting the Convention\u2019s influence on Poland. Its interpretation, carried out for years as a \u2018living treaty\u2019 interpretation, departs entirely from the original meaning of human rights. New \u2018sensitivities\u2019 are becoming more important than fundamental \u2018rights.\u2019\u201d<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>A continuation of the candidate\u2019s earlier statements<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Answering the questions on abortion in the Sejm, Sylwia Gregorczyk-Abram made it clear that, as Commissioner for Human Rights, she would most likely fully maintain the view she expressed nearly six years ago, in an <a href=\"https:\/\/tvn24.pl\/polska\/aborcja-w-przypadku-uposledzenia-plodu-nielegalna-komentarz-mecenas-sylwii-gregorczyk-abram-z-inicjatywy-wolne-sady-st4729628\" target=\"_blank\" rel=\"noreferrer noopener\">interview of October 23, 2020, on the TVN24 network<\/a>. She stated in it that \u201cpersons who are not judges took part in issuing this decision,\u201d and therefore \u201cthis judgment is invalid,\u201d and that Polish mothers who wish to take the lives of their children may \u201cmake use of the so-called abortion underground.\u201d The current position of the candidate for Commissioner regarding the alleged supremacy of the European Convention on Human Rights over the Polish Constitution is likewise a continuation of her previous statements. Nearly five years ago, in an <a href=\"https:\/\/tvn24.pl\/polska\/tk-zdecydowal-w-sprawie-europejskiej-konwencji-praw-czlowieka-sylwia-gregorczyk-abram-komentuje-st5501343\" target=\"_blank\" rel=\"noreferrer noopener\">interview of November 24, 2021, on TVN24<\/a>, she said that the Constitutional Tribunal\u2019s judgment of that day, holding that the ECtHR has no competence to assess the legality of the election of Constitutional Tribunal judges (<a href=\"https:\/\/trybunal.gov.pl\/sprawy-w-trybunale\/katalog\/k-6-21\" target=\"_blank\" rel=\"noreferrer noopener\">case K 6\/21<\/a>), was \u201ca milestone on the road to Russia.\u201d<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Concerns for defenders of freedom of conscience<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">In practice, there is thus a justified doubt as to whether, for example, members of the medical professions who refuse to submit to the abortion \u201cguidelines\u201d of Donald Tusk\u2019s government will find support in the actions of the next Commissioner for Human Rights. The Ordo Iuris Institute will once again \u2013 as during Adam Bodnar\u2019s tenure \u2013 have to partially \u201ctake over\u201d the Commissioner\u2019s function in this area, which is in fact already happening: in December 2025, the Ordo Iuris Institute published, for example, a <a href=\"https:\/\/ordoiuris.pl\/en\/press-newsdesk\/how-should-polish-hospitals-react-to-the-tusk-governments-unlawful-abortion-guidelines-ordo-iuris-presents-a-new-guide\/\" target=\"_blank\" rel=\"noreferrer noopener\">guide for healthcare providers, including hospitals, on how to make use of the institutional conscience clause<\/a>, and it has <a href=\"https:\/\/ordoiuris.pl\/komentarz\/aborcja-jako-obowiazek-choc-sprzeczna-z-prawem-i-sumieniem-rozmowa-z-poloznymi\/\" target=\"_blank\" rel=\"noreferrer noopener\">publicized cases of violations of midwives\u2019 right to conscientious objection in the context of the abortion \u201cguidelines\u201d<\/a>. Nor can there be any certainty that the candidate for Commissioner would stand up for the employees of institutions such as the Social Insurance Institution (ZUS) and the National Health Fund (NFZ) \u2013 and potentially also for employers \u2013 who would wish to refuse to register a same-sex partner as a purported \u201cfamily member\u201d for health insurance purposes.
