announced<\/a>&nbsp;that they \u201cwelcome\u201d the inclusion of a revised<em>Code of Conduct on countering<\/em>&#8220;illegal hate speech online<strong>&#8220;<\/strong>&nbsp;in the&nbsp;<a href=\"https:\/\/www.consilium.europa.eu\/pl\/policies\/digital-services-act\/\" target=\"_blank\" rel=\"noreferrer noopener\">Digital Services Act<\/a>&nbsp;&nbsp;.<\/p>\n\n\n\n<p>The Code is a soft-law instrument adopted by the European Commission to combat illegal \u201chate speech\u201d on the Internet. The document was signed by tech industry giants, including websites and services such as Facebook, Dailymotion, Instagram, LinkedIn, TikTok, X (Twitter) and YouTube, among others. The revised code,&nbsp;<a href=\"https:\/\/commission.europa.eu\/strategy-and-policy\/policies\/justice-and-fundamental-rights\/combatting-discrimination\/racism-and-xenophobia\/eu-code-conduct-countering-illegal-hate-speech-online_en\" target=\"_blank\" rel=\"noreferrer noopener\">based on a first model adopted in 2016<\/a>, is intended to improve the fight against content that would be considered \u201cillegal hate speech\u201d&nbsp;under the national laws of member states and European Union law. The legal basis for its adoption is Article 45 of the Digital Services Act, under which the European Commission and the European Board for Digital Services are required to promote and facilitate the development of functioning voluntary codes of conduct at the EU level to combat illegal content.<\/p>\n\n\n\n<p>\u201cIllegal incitement to hatred&#8221; under the Code is understood to mean \u201con the basis of the applicable law in accordance with the relevant jurisdiction,\u201d including the following&nbsp;<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:32008F0913\" target=\"_blank\" rel=\"noreferrer noopener\">Council Framework Decision 2008\/913\/JHA of November 28, 2008, on combating certain forms and expressions of racism and xenophobia by means of criminal-law measures<\/a>. Article 9 of this legislation indicates that \u201c\u2018Hatred\u2019 should be understood as referring to hatred based on race, colour, religion, descent or national or ethnic origin.\u201d Only this definition of hate is addressed in the 2016 version of the Code.<\/p>\n\n\n\n<p>Under the revised code, its signatories commit to, among other things:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>inform users of the prohibition of \u201cillegal incitement to hate speech\u201d in its services, clearly stating the conditions and measures to be taken in the event of violations of these conditions; and<\/li>\n\n\n\n<li>introduce mechanisms whereby any user within the European Union will be able to report to signatories any content operating on their sites that the user considers \u201cillegal hate speech content.\u201d In such a case, signatories agree to review such content and take immediate action to remove or prevent access to it if it violates signatory policies or the Digital Services Act (Article 16);<\/li>\n\n\n\n<li>review the majority (at least 50%) of notifications received from monitoring entities under Articles 16 and 22 of the Digital Services Act within 24 hours;<\/li>\n\n\n\n<li>cooperate with civil-society organizations for the above purposes; and<\/li>\n\n\n\n<li>cultivate tools and methods for alternative narratives, new ideas and initiatives, and educational programs that encourage online civility and critical thinking.<\/li>\n<\/ul>\n\n\n\n<p>Compared to its 2016 predecessor, the Code of Conduct on Countering Illegal Hate Speech Online + has been significantly expanded in terms of volume, as a result of the addition of two annexes. These documents provide more detailed explanations of the procedures and terminology found in the Code.<\/p>\n\n\n\n<p>\u201cThe decision to amend and incorporate the Code of Conduct on Countering Illegal Hate Speech Online into the Digital Services Act has been met with considerable criticism. Therefore, it is not surprising to see a negative reaction to the Code, which is part of the broader efforts of the European Union to place regulations combating \u2018hate speech\u2019 above the
