He exposed the influence of the EU and other foreign entities on the elections in Poland, as well as the situation that came close to a coup d\u2019\u00e9tat by the governing EU-backed left-liberal coalition of Donald Tusk following the election of Karol Nawrocki. Ultimately, the crisis was resolved thanks to public opinion and the decision of Sejm Speaker\u2014and governing-coalition member\u2014Szymon Ho\u0142ownia, who, despite persuasion and pressure, did not go so far as to refuse to swear in the newly elected President.<\/p>\n\n\n\n<p>This resonated in Brussels the Battle for the Soul of Europe conference\u2019s second keynote session on the following topic: Democracy Under Attack \u2013 How to Respond to Election Interference.<\/p>\n\n\n\n<p>The European Commission talks incessantly about foreign election interference, and in December 2024, the European Parliament\u2019s special committee on the European Democracy Shield (EUDS) was set up to produce proposals to counter foreign information manipulation, support independent media and journalists, and protect civil society. But as we have seen time and again, the EU supports media and NGOs that promote its federalist narratives and is only too happy to see parties and candidates banned from standing that offer an alternative vision.<\/p>\n\n\n\n<p>So how can we defend democracy from the European Union\u2019s election interference?<\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong><span style=\"text-decoration: underline;\">Below is Jerzy Kwa\u015bniewski\u2019s full speech this week in Brussels:<\/span><\/strong><\/p>\n\n\n\n<p><strong>Ladies and gentlemen,<\/strong><\/p>\n\n\n\n<p>After the remarks given by my colleagues, I am optimistic. The forceful tightening of the grip on our liberties and political rights by the EU belongs to the typical category of the pre-agonal spasm of a dictatorship that has lost its grip on the souls and hearts of the people.<\/p>\n\n\n\n<p>That\u2019s an optimistic approach. It means that the EU\u2019s liberal hegemony is dying before our eyes. It means that\u2014even when confronted with all its cruel might\u2014we may still win in free elections.<\/p>\n\n\n\n<p>And that is precisely the topic of my remarks today, as I address the general issue of election interference through a case study of the circumstances in which the Polish presidential elections were won by the conservative side.<\/p>\n\n\n\n<p>In some cases\u2014such as Hungary\u2014we are witnessing direct, blatant political interference by the European Commission in the national politics of EU Member States. A democratically elected government is targeted through double standards and through the weaponization of EU funds and EU policies.<\/p>\n\n\n\n<p>But interference also takes more subtle forms. Sometimes it is not an aggressive attack, but a selective blindness\u2014a refusal to acknowledge obvious violations of the rule of law when they are committed by governments favored by Brussels. A refusal to defend the democratic rights of the opposition or to safeguard media pluralism when the violators happen to be liberal forces aligned with the European establishment.<\/p>\n\n\n\n<p>This is precisely what happened in Poland in the months preceding this year\u2019s presidential election.<\/p>\n\n\n\n<p><a href=\"https:\/\/ordoiuris.pl\/en\/press-newsdesk\/polands-eu-favorite-donald-tusk-now-fighting-real-democracy-with-militant-democracy\/\">On September 10, 2024<\/a>, Prime Minister Donald Tusk openly stated that he would be operating under the concept of so-called \u201cmilitant democracy.\u201d As he admitted, this concept anticipates the commission of acts that \u201cwill be incompatible or not fully compliant with the provisions of the law.\u201d<\/p>\n\n\n\n<p>And so, by means of militant democracy, <a href=\"https:\/\/rule-of-law-observer.pl\/\" target=\"_blank\" rel=\"noreferrer noopener\">a liberal takeover was implemented<\/a>\u2014fully, aggressively, systematically. The Minister of Culture appointed new supervisory boards of the public media, which appointed new management boards\u2014even though statutory law vests these powers exclusively in the National Media Council. That Council was simply bypassed.<\/p>\n\n\n\n<p>To secure this capture, public media <a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/how-bartlomiej-sienkiewicz-liquidated-not-the-polish-television-telewizja-polska\/\" target=\"_blank\" rel=\"noreferrer noopener\">were subsequently placed in liquidation<\/a>, giving the government full and direct control, transforming state media into a political tool.<\/p>\n\n\n\n<p>What shocked ordinary citizens was the symbolic moment during this forced takeover: the broadcasting signal of public television and radio was switched off.<\/p>\n\n\n\n<p>This had not happened since the martial law of 1981, when the communist regime sought to crush the Solidarity movement.<\/p>\n\n\n\n<p>At the same time, new proceedings were initiated to revoke the broadcasting licenses of conservative private media.<\/p>\n\n\n<style>.wp-block-kadence-advancedheading.kt-adv-heading35314_f27f92-b0, .wp-block-kadence-advancedheading.kt-adv-heading35314_f27f92-b0[data-kb-block=\"kb-adv-heading35314_f27f92-b0\"]{font-style:normal;}.wp-block-kadence-advancedheading.kt-adv-heading35314_f27f92-b0 mark.kt-highlight, .wp-block-kadence-advancedheading.kt-adv-heading35314_f27f92-b0[data-kb-block=\"kb-adv-heading35314_f27f92-b0\"] mark.kt-highlight{font-style:normal;color:#f76a0c;-webkit-box-decoration-break:clone;box-decoration-break:clone;padding-top:0px;padding-right:0px;padding-bottom:0px;padding-left:0px;}.wp-block-kadence-advancedheading.kt-adv-heading35314_f27f92-b0 img.kb-inline-image, .wp-block-kadence-advancedheading.kt-adv-heading35314_f27f92-b0[data-kb-block=\"kb-adv-heading35314_f27f92-b0\"] img.kb-inline-image{width:150px;vertical-align:baseline;}<\/style>\n<h4 class=\"kt-adv-heading35314_f27f92-b0 wp-block-kadence-advancedheading\" data-kb-block=\"kb-adv-heading35314_f27f92-b0\"><strong>Second Priority: The Courts<\/strong><\/h4>\n\n\n\n<p>The Ministry of Justice <a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/the-polish-constitutional-tribunal-confirms-the-regulation-of-donald-tusks-justice-minister-is-unconstitutional\/\" target=\"_blank\" rel=\"noreferrer noopener\">seized control of case-assignment procedures<\/a> so that the most politically sensitive cases could be directed to the most politically aligned judges.<\/p>\n\n\n\n<p>Presidents of courts <a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/minister-of-justice-waldemar-zurek-announced-the-dismissal-of-court-presidents-and-vice-presidents-despite-the-negative-opinion-of-the-court-councils\/\" target=\"_blank\" rel=\"noreferrer noopener\">were dismissed illegally<\/a>, judicial disciplinary functions <a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/minister-bodnar-appointed-a-disciplinary-ombudsman-for-judges-of-courts-of-general-jurisdiction-even-though-this-position-remains-vacant\/\" target=\"_blank\" rel=\"noreferrer noopener\">were taken over<\/a> by government loyalists, and even the iron safes in the offices of the National Council of the Judiciary <a href=\"https:\/\/obserwator-praworzadnosci.pl\/wp-content\/uploads\/2025\/04\/Report-on-Violations-net.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">were physically forced open<\/a> to obtain disciplinary files.<\/p>\n\n\n\n<p>New procedures\u2014so-called \u201ctests of independence\u201d\u2014<a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/donald-tusks-government-is-pushing-the-same-measures-that-the-polish-constitutional-tribunal-has-already-rejected-once\/\" target=\"_blank\" rel=\"noreferrer noopener\">were drafted to challenge the status of more than 3,000 judges<\/a>.<\/p>\n\n\n<style>.wp-block-kadence-advancedheading.kt-adv-heading35314_d15ff8-20, .wp-block-kadence-advancedheading.kt-adv-heading35314_d15ff8-20[data-kb-block=\"kb-adv-heading35314_d15ff8-20\"]{font-style:normal;}.wp-block-kadence-advancedheading.kt-adv-heading35314_d15ff8-20 mark.kt-highlight, .wp-block-kadence-advancedheading.kt-adv-heading35314_d15ff8-20[data-kb-block=\"kb-adv-heading35314_d15ff8-20\"] mark.kt-highlight{font-style:normal;color:#f76a0c;-webkit-box-decoration-break:clone;box-decoration-break:clone;padding-top:0px;padding-right:0px;padding-bottom:0px;padding-left:0px;}.wp-block-kadence-advancedheading.kt-adv-heading35314_d15ff8-20 img.kb-inline-image, .wp-block-kadence-advancedheading.kt-adv-heading35314_d15ff8-20[data-kb-block=\"kb-adv-heading35314_d15ff8-20\"] img.kb-inline-image{width:150px;vertical-align:baseline;}<\/style>\n<h4 class=\"kt-adv-heading35314_d15ff8-20 wp-block-kadence-advancedheading\" data-kb-block=\"kb-adv-heading35314_d15ff8-20\"><strong>Third Priority: Using Criminal Justice Against the Opposition<\/strong><\/h4>\n\n\n\n<p>The offices of the National Prosecutor <a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/takeover-of-the-national-prosecutors-office\/\" target=\"_blank\" rel=\"noreferrer noopener\">were taken over by force<\/a>. A new National Prosecutor was appointed without the statutorily required opinion of the President.<\/p>\n\n\n\n<p><a href=\"https:\/\/eclj.org\/geopolitics\/pace\/crackdown-on-populist-opposition-in-poland-pace-intervenes-to-defend-mps-immunity\" target=\"_blank\" rel=\"noreferrer noopener\">Political investigations were turned into public spectacles<\/a>. Parliamentary investigative committees were created, and key prosecution witnesses delivered testimony live, without the presence of the defense and without the possibility of cross-examination.<\/p>\n\n\n\n<p>Homes and offices of multiple politicians and NGO leaders were searched; documents, computers, and phones were seized. Some individuals\u2014<a href=\"https:\/\/ordoiuris.pl\/en\/press-newsdesk\/fr-olszewskis-detention-is-a-politically-motivated-case-and-sets-a-new-precedent-in-post-communist-poland-his-defense-attorney-says-in-an-interview-with-ordo-iuris-video\/\" target=\"_blank\" rel=\"noreferrer noopener\">including Father Olszewski<\/a>\u2014were arrested. Even the liberal Ombudsman acknowledged the mistreatment of the priest.<\/p>\n\n\n\n<p>A former Deputy Minister of Justice <a href=\"https:\/\/brusselssignal.eu\/2024\/12\/orban-offers-political-asylum-to-polish-opposition-mp-persecuted-by-rainbow-government\/\" target=\"_blank\" rel=\"noreferrer noopener\">was granted political asylum in Hungary<\/a>.<\/p>\n\n\n<style>.wp-block-kadence-advancedheading.kt-adv-heading35314_6ce788-56, .wp-block-kadence-advancedheading.kt-adv-heading35314_6ce788-56[data-kb-block=\"kb-adv-heading35314_6ce788-56\"]{font-style:normal;}.wp-block-kadence-advancedheading.kt-adv-heading35314_6ce788-56 mark.kt-highlight, .wp-block-kadence-advancedheading.kt-adv-heading35314_6ce788-56[data-kb-block=\"kb-adv-heading35314_6ce788-56\"] mark.kt-highlight{font-style:normal;color:#f76a0c;-webkit-box-decoration-break:clone;box-decoration-break:clone;padding-top:0px;padding-right:0px;padding-bottom:0px;padding-left:0px;}.wp-block-kadence-advancedheading.kt-adv-heading35314_6ce788-56 img.kb-inline-image, .wp-block-kadence-advancedheading.kt-adv-heading35314_6ce788-56[data-kb-block=\"kb-adv-heading35314_6ce788-56\"] img.kb-inline-image{width:150px;vertical-align:baseline;}<\/style>\n<h4 class=\"kt-adv-heading35314_6ce788-56 wp-block-kadence-advancedheading\" data-kb-block=\"kb-adv-heading35314_6ce788-56\"><strong>Fourth Priority: The Constitutional Tribunal<\/strong><\/h4>\n\n\n\n<p>Three judicial appointments to the Constitutional Court were declared invalid. Entire decisions of the Tribunal were declared null and void. Since then, the government <a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/the-ombudsman-has-once-again-spoken-out-in-defence-of-the-constitutional-tribunal-and-the-extraordinary-review-and-public-affairs-chamber-of-the-supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">has ignored every interim order issued by the Constitutional Tribunal<\/a>.<\/p>\n\n\n\n<p>\u201cMilitant democracy\u201d cannot function in a state with effective constitutional review.<\/p>\n\n\n<style>.wp-block-kadence-advancedheading.kt-adv-heading35314_1f47c3-cb, .wp-block-kadence-advancedheading.kt-adv-heading35314_1f47c3-cb[data-kb-block=\"kb-adv-heading35314_1f47c3-cb\"]{font-style:normal;}.wp-block-kadence-advancedheading.kt-adv-heading35314_1f47c3-cb mark.kt-highlight, .wp-block-kadence-advancedheading.kt-adv-heading35314_1f47c3-cb[data-kb-block=\"kb-adv-heading35314_1f47c3-cb\"] mark.kt-highlight{font-style:normal;color:#f76a0c;-webkit-box-decoration-break:clone;box-decoration-break:clone;padding-top:0px;padding-right:0px;padding-bottom:0px;padding-left:0px;}.wp-block-kadence-advancedheading.kt-adv-heading35314_1f47c3-cb img.kb-inline-image, .wp-block-kadence-advancedheading.kt-adv-heading35314_1f47c3-cb[data-kb-block=\"kb-adv-heading35314_1f47c3-cb\"] img.kb-inline-image{width:150px;vertical-align:baseline;}<\/style>\n<h4 class=\"kt-adv-heading35314_1f47c3-cb wp-block-kadence-advancedheading\" data-kb-block=\"kb-adv-heading35314_1f47c3-cb\"><strong>Fifth Priority: The Supreme Court<\/strong><\/h4>\n\n\n\n<p>The official Action Plan presented to the European Commission claimed that reforms would \u201cstrengthen the independence of the Supreme Court,\u201d especially regarding the Chamber of Extraordinary Control.<\/p>\n\n\n\n<p>But no details ever materialized, as President Duda did not accept any of the proposed statutory solutions\u2014each of them effectively meaning a capture of the Supreme Court by the liberals.<\/p>\n\n\n\n<p>The liberal blitzkrieg reached a stalemate at this point, because its sixth and most important priority\u2014capturing the Office of the President\u2014was still out of reach.<\/p>\n\n\n<style>.wp-block-kadence-advancedheading.kt-adv-heading35314_3aec55-aa, .wp-block-kadence-advancedheading.kt-adv-heading35314_3aec55-aa[data-kb-block=\"kb-adv-heading35314_3aec55-aa\"]{font-style:normal;}.wp-block-kadence-advancedheading.kt-adv-heading35314_3aec55-aa mark.kt-highlight, .wp-block-kadence-advancedheading.kt-adv-heading35314_3aec55-aa[data-kb-block=\"kb-adv-heading35314_3aec55-aa\"] mark.kt-highlight{font-style:normal;color:#f76a0c;-webkit-box-decoration-break:clone;box-decoration-break:clone;padding-top:0px;padding-right:0px;padding-bottom:0px;padding-left:0px;}.wp-block-kadence-advancedheading.kt-adv-heading35314_3aec55-aa img.kb-inline-image, .wp-block-kadence-advancedheading.kt-adv-heading35314_3aec55-aa[data-kb-block=\"kb-adv-heading35314_3aec55-aa\"] img.kb-inline-image{width:150px;vertical-align:baseline;}<\/style>\n<p class=\"kt-adv-heading35314_3aec55-aa wp-block-kadence-advancedheading\" data-kb-block=\"kb-adv-heading35314_3aec55-aa\"><strong>Let us stress this:<\/strong><\/p>\n\n\n\n<p>Throughout this entire process, the European Commission <a href=\"https:\/\/ordoiuris.pl\/en\/comments\/when-defending-the-rule-of-law-serves-politics-the-european-commissions-report-on-poland\/\">has provided unwavering political support<\/a> to Donald Tusk\u2019s \u201cmilitant democracy.\u201d<\/p>\n\n\n\n<p>After months of blatant constitutional violations, the Commission declared that Poland was no longer at risk of any serious breach of the rule of law.<\/p>\n\n\n\n<p>President von der Leyen celebrated the moment: \u201cToday marks a new chapter for Poland.\u201d<\/p>\n\n\n\n<p>The goal was obvious. <em>Le Monde<\/em> reported that \u201cthe head of the European Commission showed keen interest in strengthening the Polish prime minister\u2019s position during the presidential election.\u201d<\/p>\n\n\n\n<p>The constitutional violations ignored by Brussels <a href=\"https:\/\/x.com\/OrdoIuris_Int\/status\/1892526279456354311\" target=\"_blank\" rel=\"noreferrer noopener\">were not ignored in Washington<\/a>. Congressman Brian Mast, chairman of the U.S. House Foreign Affairs Committee, wrote to President von der Leyen expressing \u201cprofound alarm\u201d over developments in Poland that threatened \u201cthe integrity of its democratic processes.\u201d<\/p>\n\n\n\n<p>Emboldened by Brussels\u2019 support, Donald Tusk moved to suffocate the democratic opposition financially.<\/p>\n\n\n\n<p>The National Electoral Commission refused public funding to Law and Justice, the largest opposition party.<\/p>\n\n\n\n<p>Even after the Supreme Court annulled this decision, the Minister of Finance <a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/osce-observation-mission-statement-on-the-first-round-of-polish-presidential-elections-abuses-noted-but-not-adequately-highlighted\/\" target=\"_blank\" rel=\"noreferrer noopener\">still refused to release tens of millions of euros<\/a> to which PiS is legally entitled. At the same time, millions flowed to the liberals.<\/p>\n\n\n\n<p>The election that followed was one of the most tense and unbalanced campaigns since the fall of communism.<\/p>\n\n\n\n<p>The leading conservative candidate, Karol Nawrocki, ran without access to public funding, while public media\u2014already placed in liquidation\u2014served as a tool of the government.<\/p>\n\n\n\n<p>Brussels repeatedly signaled political support for the government\u2019s actions. Some EU figures even hinted at their preferred presidential candidate.<\/p>\n\n\n\n<p>And when the voters chose otherwise, it was suddenly the result itself that came into question.<\/p>\n\n\n\n<p>Some politicians even proposed delaying the inauguration. The Speaker of Parliament, Szymon Ho\u0142ownia, later admitted that he was repeatedly pressured to postpone the swearing-in of President-elect Nawrocki\u2014an action that would have temporarily transferred presidential powers to himself. Ho\u0142ownia described this plan frankly as a \u201ccoup d\u2019\u00e9tat.\u201d<\/p>\n\n\n\n<p>For many Poles, it echoed the past, when the real decisions affecting the nation were taken not in Warsaw but in communist committees in Moscow.<\/p>\n\n\n\n<p>In this context, nobody should be surprised by President Nawrocki\u2019s strong stance on the future of the European Union, <a href=\"https:\/\/www.president.pl\/news\/lecture-of-president-nawrocki-at-the-crossroads--a-defining-post-cold-war-moment-for-europe-on-karols-university-in-prag,110846\" target=\"_blank\" rel=\"noreferrer noopener\">expressed last week at Charles University in Prague<\/a>.<\/p>\n\n\n\n<p>He declared: \u201cWe advocate for the rejection of the project of EU centralization. In matters concerning our political system and the future of Europe, it is presidents, governments, and parliaments that have a true democratic mandate, obtained through free elections \u2013 not the European Commission and its subordinate institutions.\u201d<\/p>\n\n\n\n<p>He warned against dissolving national identities into a vague, unaccountable supranational bureaucracy dominated by a centralized EU system. upon whom my name has been pronounced, humble themselves and pray, and seek my face and turn from their evil ways, I will hear them from heaven and pardon their sins and heal their
