class=\"wp-block-heading\">Consensus without a vote, a dispute over words<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The UN Human Rights Council has completed <a href=\"https:\/\/hrcmeetings.ohchr.org\/HRCSessions\/RegularSessions\/62\/DL_Resolution\/2609730E.docx\" target=\"_blank\" rel=\"noreferrer noopener\">work on a resolution<\/a> titled \u201cPromoting, protecting and respecting women\u2019s and girls\u2019 full enjoyment of human rights in humanitarian situations.\u201d The document formally concerns the protection of the rights of women and girls in \u201chumanitarian situations\u201d\u2014that is, during natural disasters, armed conflicts, and forced displacement. The resolution was <a href=\"https:\/\/www.ohchr.org\/en\/meeting-summaries\/2026\/07\/human-rights-council-concludes-sixty-second-regular-session-after\">adopted <\/a><a href=\"https:\/\/www.ohchr.org\/en\/meeting-summaries\/2026\/07\/human-rights-council-concludes-sixty-second-regular-session-after\" target=\"_blank\" rel=\"noreferrer noopener\">without<\/a><a href=\"https:\/\/www.ohchr.org\/en\/meeting-summaries\/2026\/07\/human-rights-council-concludes-sixty-second-regular-session-after\"> a vote<\/a>, which in the Council\u2019s diplomatic practice means that no member state chose to formally block the text; this does not, however, automatically signify universal agreement on every one of its elements, but only the absence of any will to open confrontation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What sets this document apart from the routine, annual thematic resolutions the Council adopts in its June cycle devoted to women\u2019s rights is a single phrase in the preamble. As the <a href=\"https:\/\/www.ippf.org\/news\/un-human-rights-council-adopts-first-negotiated-resolution-naming-reproductive-violence\" target=\"_blank\" rel=\"noreferrer noopener\">International Planned Parenthood Federation (IPPF)<\/a>\u2014an organization that has lobbied for decades to expand the legal availability of abortion\u2014points out, this is the first instance in which a negotiated UN outcome document (that is, one agreed upon by member states, not merely by experts or rapporteurs) has employed the term \u201creproductive violence\u201d as a distinct, named category of gender-based violence.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">What exactly does the text say?<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The resolution\u2019s preamble expresses deep concern that women and girls in \u201chumanitarian situations\u201d are disproportionately affected by sexual and gender-based violence, including conflict-related sexual violence, trafficking in persons, sexual exploitation, and sexual slavery, as well as\u2014and this is formulated for the first time\u2014\u201creproductive violence such as forced or denial of contraception, forced pregnancy, forced abortion and forced sterilization, including when undertaken with the intent to destroy a group.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The final part of this sentence alludes to Article II of the 1948 Convention on the Prevention and Punishment of the Crime of Genocide, which defines genocide as an act committed \u201cwith intent to destroy, in whole or in part,\u201d a national, ethnical, racial, or religious group. The resolution thus places \u201creproductive violence\u201d in the context of the gravest crimes under international law\u2014which corresponds with the findings of the <a href=\"https:\/\/www.un.org\/unispal\/document\/report-of-the-commission-of-inquiry-israel-gender-based-violence-13march2025\/\" target=\"_blank\" rel=\"noreferrer noopener\">UN Commission of Inquiry on the Occupied Palestinian Territory<\/a> (which in March 2025 documented \u201csexual and reproductive violence\u201d related to the conflict in the Gaza Strip), as well as with the <a href=\"https:\/\/docs.un.org\/en\/E\/CN.6\/2025\/3\" target=\"_blank\" rel=\"noreferrer noopener\">UN Secretary-General\u2019s 2025 review of the implementation of the Beijing Declaration<\/a>, which pointed to elevated levels of \u201creproductive violence\u201d in Gaza, Sudan, Yemen, Syria, and Ukraine.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The American columnist Carrie N. Baker, in a piece for \u201c<a href=\"https:\/\/msmagazine.com\/2026\/07\/25\/united-nations-abortion-bans-usa-reproductive-violence-forced-birth-pregnancy\/\" target=\"_blank\" rel=\"noreferrer noopener\">Ms. Magazine<\/a>,\u201d interprets the document far more broadly than its literal wording warrants\u2014suggesting that the UN has thereby also labeled national restrictions on access to abortion, in force in many democratic states in peacetime, as \u201cforced birth.\u201d The text of the resolution itself, however, speaks solely of forced abortion and forced pregnancy in the context of \u201chumanitarian situations\u201d and armed conflicts\u2014not of the refusal to perform abortion on demand within a state\u2019s legal, democratically established legal order. This distinction is of fundamental legal significance, even though\u2014as the track record of similar terms within the UN system shows\u2014it tends to become blurred over time.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">A mechanism we already know<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The history of international law and human rights knows precedents for such \u201ccreep\u201d of terminology from a narrow humanitarian context into the broad context of states\u2019 domestic policy. It is worth recalling that the very concept of \u201csexual and reproductive health and rights\u201d (SRHR) was born at the International Conference on Population and Development in Cairo in 1994 as a descriptive, legally non-binding term\u2014and today it is routinely invoked by UN treaty bodies, special rapporteurs, and the European Parliament as a basis for demanding that member states expand the legal availability of abortion, even though no international human rights treaty establishes any so-called right to abortion outright.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A similar process can be anticipated for \u201creproductive violence.\u201d This term\u2014<a href=\"https:\/\/www.unfpa.org\/publications\/shining-light-reproductive-violence-contribution-understanding-all-forms-gender-based\" target=\"_blank\" rel=\"noreferrer noopener\">defined more broadly by the United Nations Population Fund (UNFPA)<\/a> as intentional acts or omissions that violate \u201creproductive autonomy\u201d\u2014also encompasses, in the view of UNFPA and <a href=\"https:\/\/www.unwomen.org\/sites\/default\/files\/2024-09\/research-paper-documenting-reproductive-violence-en.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">UN Women<\/a> (the UN entity meant to work for women\u2019s rights), \u201cattacks on reproductive healthcare facilities.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From the standpoint of protecting states\u2019 sovereignty in shaping their own family and health policies, inserting the term \u201creproductive violence\u201d into an official, agreed UN document raises the risk of an expansive interpretation. A term that arose in the context of war crimes and the crime of genocide (forced pregnancies in camps, forced sterilization of minorities) may, over time and through successive reports and general comments by treaty bodies, be extended to matters lying beyond the drafters\u2019 intentions.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Planned Parenthood is pleased<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Dr. Diana Pulido of Planned Parenthood Humanitarian <a href=\"https:\/\/www.ippf.org\/news\/un-human-rights-council-adopts-first-negotiated-resolution-naming-reproductive-violence\" target=\"_blank\" rel=\"noreferrer noopener\">assessed the document\u2019s adoption<\/a> as \u201can important step forward for women and girls in humanitarian crises,\u201d stressing that naming the phenomenon finally makes it possible to see \u201ca distinct and devastating form of harm that has too often gone unrecognised.\u201d Supporters of the resolution\u2014including UNFPA\u2014argue that without a distinct name for \u201creproductive violence,\u201d the victims of forced pregnancies or forced sterilization (phenomena that are also indisputably condemned by international humanitarian law and the Rome Statute of the International Criminal Court) are left without adequate legal language to describe the harm done to them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Protecting women and girls from sexual and reproductive violence in zones of armed conflict and in humanitarian situations is one of the most indisputable and urgent obligations of the international community. This is confirmed by documented cases from Gaza, Sudan, Ukraine, and Myanmar. What is troubling, however, is the use, for this purpose, of ideological formulations that lend themselves to broad interpretation.
