Now, the Minister has decided to go one step further and appoint new people to these positions, regardless of the fact that the alleged dismissals were legally flawed.<\/strong><\/p>\n\n\n\n<p>Yesterday (16 July 2025),\u00a0<a href=\"https:\/\/www.gov.pl\/web\/sprawiedliwosc\/minister-sprawiedliwosci-powolal-rzecznika-dyscyplinarnego-sedziow-sadow-powszechnych-i-jego-zastepce\" target=\"_blank\" rel=\"noreferrer noopener\">the Ministry of Justice announced<\/a>\u00a0that Minister Bodnar had appointed Mariusz Ulman, a judge of the District Court in Nysa, as Disciplinary Ombudsman for Judges of Courts of General Jurisdiction, and Tomasz \u0141adny , Judge of the District Court for Warsaw Praga-P\u00f3\u0142noc in Warsaw, as his deputy. The problem is that both of these positions are currently held by judges Piotr Schab and Przemys\u0142aw Radzik, whose terms of office do not expire until June 2026.<\/p>\n\n\n\n<p>As we have already\u00a0<a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/the-ministry-is-clinging-to-its-own-narrative-about-the-possibility-of-dismissing-disciplinary-spokespeople-despite-the-lack-of-legal-grounds-a-bizarre-letter-to-court-presidents\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported several times on our website<\/a>, the Ministry of Justice itself admitted that the provisions of the\u00a0<a href=\"https:\/\/isap.sejm.gov.pl\/isap.nsf\/DocDetails.xsp?id=WDU20010981070\" target=\"_blank\" rel=\"noreferrer noopener\">Law on the System of Common Courts<\/a>\u00a0do not include any provision that would authorise the Minister of Justice to dismiss the Ombudsman or his Deputy before the end of their term of office. In view of the above, it should be emphasised once again that both attempts at dismissal, as\u00a0<strong>grossly contrary to the principle of legality<\/strong>\u00a0(Article 7 of the Constitution
