class=\"kt-inside-inner-col\">\n<p><\/p>\n\n\n\n<p>Attempts by the executive branch, in the person of the Minister of Justice, to exert extra-legal influence on the judiciary are, unfortunately, one of the main hallmarks of the so-called \u2018restoration of the rule of law\u2019 by the current government. This includes, in particular, attempts to take action&nbsp;<strong>without any legal basis<\/strong>&nbsp;or in serious violation of the law, contrary to&nbsp;<strong>the provisions of Article 7 of the Constitution (<em>Public authorities shall act on the basis of and within the limits of the law<\/em>).<\/strong><\/p>\n\n\n\n<p>Such actions, initially taken almost from the very beginning of his term of office by Minister Adam Bodnar and now continued by his successor, Waldemar \u017burek, include\u00a0<strong>announcing the dismissal of court presidents and vice-presidents<\/strong>. The function of the president of a given court is extremely important from the point of view of the daily work of the judiciary \u2013 in accordance with Articles 22 and 21 of the\u00a0<a href=\"https:\/\/isap.sejm.gov.pl\/isap.nsf\/DocDetails.xsp?id=WDU20010981070\" target=\"_blank\" rel=\"noreferrer noopener\">Law on the System of Common Courts<\/a>, the president of the court, among other things, manages the court and represents it externally, ensures the proper internal functioning of the court, and is the superior of judges, assistant judges, court clerks and assistants to judges of the court, assigns and dismisses judges, assistant judges and court clerks, and (after consulting the court\u2019s collegium)\u00a0<strong>determines the assignment of judges, assistant judges and court clerks to court divisions, their duties, the manner of their participation in the assignment of cases<\/strong>, and the duty and substitution schedule. The latter competence is particularly important, as it has recently been\u00a0<strong>used to circumvent\u00a0<\/strong><a href=\"https:\/\/niezalezna.pl\/polska\/zeslani-do-sekcji-sedzia-lenarczyk-dla-niezalezna-pl-to-w-istocie-getto-na-co-nie-moze-byc-zgody\/535489\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>the principle of random assignment of cases to judicial panels<\/strong><\/a>\u00a0(Minister \u017burek has recently presented a draft bill that\u00a0<strong>directly restricts this principle<\/strong>, in a manner that is otherwise contrary to the law \u2013 if adopted, as\u00a0<a href=\"https:\/\/obserwator-praworzadnosci.pl\/pl\/minister-zurek-przedstawil-projekt-ktory-de-facto-znosi-losowy-przydzial-spraw-poszczegolnym-sedziom\/\" target=\"_blank\" rel=\"noreferrer noopener\">we recently reported<\/a>, the role of court presidents would become even more important).<\/p>\n\n\n\n<p>It is therefore not surprising that ministers have attempted to influence the judiciary by dismissing presidents considered unfavourable to the government and appointing their own nominees in their place. The actions of Minister Bodnar, who,\u00a0<a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/attempt-to-forcibly-remove-the-president-of-the-court-of-appeals-in-warsaw\/\" target=\"_blank\" rel=\"noreferrer noopener\">often guided by political motivations<\/a>, attempted to announce the dismissal of court presidents,\u00a0<a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/purges-in-court-management-boards\/\" target=\"_blank\" rel=\"noreferrer noopener\">bending the applicable procedure<\/a>, led to the Constitutional Tribunal issuing\u00a0<a href=\"https:\/\/trybunal.gov.pl\/postepowanie-i-orzeczenia\/wyroki\/art\/procedura-odwolania-prezesa-lub-wiceprezesa-sadu-2\" target=\"_blank\" rel=\"noreferrer noopener\">its ruling of 16 October 2024. K 2\/24<\/a>, which found\u00a0<strong>that this procedure was partially unconstitutional<\/strong>. Meanwhile, Minister \u017burek not only\u00a0<strong>ignored this ruling<\/strong>\u00a0entirely, but also openly and explicitly declared that he\u00a0<strong>would not adhere to the applicable procedure<\/strong>\u00a0set out in Article 27 of the Law on the System of Common Courts!<\/p>\n\n\n\n<p>(\u2026)<\/p>\n\n\n\n<p><a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/minister-of-justice-waldemar-zurek-announced-the-dismissal-of-court-presidents-and-vice-presidents-despite-the-negative-opinion-of-the-court-councils\/\"
