distinctive attitude of the current Polish Minister of Justice, Waldemar \u017burek, toward the principles of the independence of the courts and\u00a0<a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/attack-on-democratic-institutions\/the-justice-system-en\/independence-of-judges-en\/\" target=\"_blank\" rel=\"noreferrer noopener\">judicial independence<\/a>\u00a0is certainly well known to the regular readers of our Rule of Law Observer. It stems in part from the conflict over\u00a0<a href=\"https:\/\/eclj.org\/geopolitics\/eu\/la-reforme-du-conseil-de-la-magistrature-polonais-et-lindependance-de-la-justice?lng=en\" target=\"_blank\" rel=\"noreferrer noopener\">the reform of the Polish judiciary<\/a>, undertaken by the previous United Right coalition government led by Law and Justice (PS). In this conflict, the EU institutions, overstepping their authority, clearly\u00a0<a href=\"https:\/\/eclj.org\/geopolitics\/eu\/lattaque-de-la-commission-europeenne-contre-la-reforme-de-la-justice-en-pologne--resume-chronologie-et-enjeux?lng=en\" target=\"_blank\" rel=\"noreferrer noopener\">sided with the then left-liberal opposition<\/a>, which today governs under the leadership of former European Council President Donald Tusk.<\/p>\n\n\n\n<p>At the end of last month, however, the current ruling coalition crossed yet another line. Poland\u2019s Minister of Justice has sent letters to the\u00a0<a href=\"https:\/\/www.gov.pl\/web\/prokuratura-krajowa\/dzialania-prokuratora-generalnego-wobec-naruszen-prawa-w-sadzie-najwyzszym\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court<\/a>\u00a0(SN) and to the\u00a0<a href=\"https:\/\/www.gov.pl\/web\/prokuratura-krajowa\/kolejne-dzialania-prokuratora-generalnego-zwiazane-z-pracami-zespolu-ds-zapobiegania-negatywnym-skutkom-orzeczen-wydanych-przez-sedziow-nominowanych-w-procedurze-z-udzialem-krajowej-rady-sadownictwa-uksztaltowanej-po-2017-roku\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Administrative Court<\/a>\u00a0(NSA), in which he called on judges who have sat on both courts of last resort since 2018 to\u00a0<em>cease violating the law,\u00a0<\/em>that is, in practice, to resign from the positions they hold. If they failed to heed this appeal, Minister \u017burek threatened them with the possibility of\u00a0<strong>being held civilly or even criminally liable<\/strong>.<\/p>\n\n\n\n<p>(\u2026)<\/p>\n\n\n\n<p><a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/donald-tusks-liberal-left-government-is-pressuring-judges-seeking-to-force-them-to-resign\/\" target=\"_blank\" rel=\"noreferrer
