target=\"_blank\" rel=\"noreferrer noopener\">a resolution, bearing case number III PZP 1\/25<\/a>. This resolution unequivocally stated that:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>1<strong>.\u00a0No court or other public authority is authorized to declare a Supreme Court judgment null and void and to disregard its effects<\/strong>, even if this was to be done by invoking European Union law.<\/em><\/p>\n<\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>2.&nbsp;<strong>The Republic of Poland has not conferred on the institutions of the European Union or any other international organization the authority to enact rules governing the organization and functioning of the national judiciary<\/strong>, nor to determine the scope of their application. These powers are vested exclusively in the constitutional organs of the Republic of Poland and may not be transferred pursuant to Article 90(1) of the Constitution of the Republic of Poland; consequently, Article 91(2) and (3) in conjunction with Article 87 of the Constitution of the Republic of Poland do not apply in this respect.<\/em><\/p>\n<\/blockquote>\n\n\n\n<p>With this resolution, Poland\u2019s Supreme Court distanced itself from an earlier legal principle set out by a seven-judge panel only of the Labor and Social Insurance Chamber in\u00a0<a href=\"https:\/\/www.sn.pl\/orzecznictwo\/SitePages\/Najnowsze_orzeczenia.aspx?ItemSID=2043-301f4741-66aa-4980-b9fa-873e90506a11&amp;ListName=Zagadnienia_prawne\" target=\"_blank\" rel=\"noreferrer noopener\">the resolution dated September 24, 2025, case no. III PZP 1\/25<\/a>.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Concerns about the resolution of the Labor and Social Insurance Chamber<\/h4>\n\n\n\n<p>In that September resolution, the judges of the Chamber of Labor and Social Insurance stated that the judgments of the Chamber of Extraordinary Review and Public Affairs of the Polish Supreme Court, when rendered by a panel&nbsp;<strong>with the participation of even a single judge appointed since 2018,<\/strong>&nbsp;<strong>should be considered null and void (nonexistent)<\/strong>.<\/p>\n\n\n\n<p>This position reflects the ongoing dispute concerning a 2017 reform of the country\u2019s judiciary by the then conservative parliamentary majority and was based on a highly controversial judgment of the Court of Justice of the European Union dated September 4, 2025,\u00a0<a href=\"https:\/\/curia.europa.eu\/juris\/document\/document.jsf;jsessionid=74E87896D37D3B929E8315D30DCA1AE6?text=&amp;docid=303860&amp;pageIndex=0&amp;doclang=EN&amp;mode=req&amp;dir=&amp;occ=first&amp;part=1&amp;cid=16697766\" target=\"_blank\" rel=\"noreferrer noopener\">in case C-225\/22 AW \u201cT\u201d<\/a>. In it, the CJEU held that\u00a0<strong>Polish courts may treat judgments of the Chamber of Extraordinary Control and Public Affairs of the Polish Supreme Court (which was created as part of the said reform) as null and void, if this is necessary to ensure the primacy of EU law<\/strong>.<\/p>\n\n\n\n<p>This judgment, however, in the first place, clearly went beyond the\u00a0<strong>principle of conferral<\/strong>, laid down in Articles 4 and 5 of the\u00a0<a href=\"https:\/\/eur-lex.europa.eu\/resource.html?uri=cellar:2bf140bf-a3f8-4ab2-b506-fd71826e6da6.0023.02\/DOC_1&amp;format=PDF\" target=\"_blank\" rel=\"noreferrer noopener\">Treaty on European Union<\/a>, according to which the European Union has competences\u00a0<strong>only in those areas in which they have been conferred
