week before Christmas, on December 18, 2025, the Court of Justice of the European Union issued a\u00a0<a href=\"https:\/\/curia.europa.eu\/juris\/document\/document.jsf?text=&amp;docid=307225&amp;pageIndex=0&amp;doclang=EN&amp;mode=lst&amp;dir=&amp;occ=first&amp;part=1&amp;cid=7515133\" target=\"_blank\" rel=\"noreferrer noopener\">judgment<\/a>\u00a0in response to\u00a0<a href=\"https:\/\/curia.europa.eu\/juris\/document\/document.jsf?text=&amp;docid=276732&amp;pageIndex=0&amp;doclang=EN&amp;mode=lst&amp;dir=&amp;occ=first&amp;part=1&amp;cid=6884423\" target=\"_blank\" rel=\"noreferrer noopener\">the European Commission\u2019s complaint<\/a>\u00a0alleging a breach of EU treaties by the Republic of Poland. This breach was said to be reflected in the judgments of the Constitutional Tribunal of July 14 (case\u00a0<a href=\"https:\/\/trybunal.gov.pl\/sprawy-w-trybunale\/art\/obowiazek-panstwa-czlonkowskiego-ue-polegajacy-na-wykonywaniu-srodkow-tymczasowych-odnoszacych-sie-do-ksztaltu-ustroju-i-funkcjonowania-konstytucyjnych-organow-wladzy-sadowniczej-tego-panstwa\" target=\"_blank\" rel=\"noreferrer noopener\">P 7\/20<\/a>) and of October 7, 2021 (case\u00a0<a href=\"https:\/\/trybunal.gov.pl\/s\/k-3-21\" target=\"_blank\" rel=\"noreferrer noopener\">K 3\/21<\/a>), in which the Polish Constitutional Tribunal held that the CJEU, in adjudicating on the structure of the Polish judiciary, acted\u00a0<em>ultra vires\u00a0<\/em>(Latin: beyond one\u2019s powers), that is, outside the scope of its authority.<\/p>\n\n\n\n<p>As&nbsp;<a href=\"https:\/\/ordoiuris.pl\/en\/press-newsdesk\/cjeu-puts-itself-above-national-constitutions-in-landmark-case-against-poland\/\">we have already reported<\/a>, the CJEU agreed with the European Commission\u2019s position and ruled that the Republic of Poland violated treaty provisions.<\/p>\n\n\n\n<p>It should be noted that the ruling was greeted with satisfaction by representatives of Poland\u2019s current governing coalition, as a blow against their predecessors:<\/p>\n\n\n\n<p>The Polish government\u2019s stance, while saddening, is unfortunately not surprising. It is particularly reprehensible that the government of Donald Tusk, campaigning under the banner of \u201crestoring the rule of law,\u201d continues\u00a0<a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/attack-on-democratic-institutions\/the-justice-system-en\/constitutional-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">its line<\/a>\u00a0<strong>of delegitimizing the Polish Constitutional Tribunal, whose task is to safeguard that very rule of law and to prevent the executive branch of government from enacting \u201cstatutory lawlessness\u201d\u2014normative acts that are contrary to the Constitution<\/strong>. Something that the government, especially lately, has been carrying out very actively with full support from the European Commission (as, for example, in the judgment of November 12, 2025\u00a0<a href=\"https:\/\/trybunal.gov.pl\/postepowanie-i-orzeczenia\/wyroki\/art\/rozporzadzenie-ministra-sprawiedliwosci-w-sprawie-zmiany-rozporzadzenia-regulamin-urzedowania-sadow-powszechnych-odstepstwo-od-ustanowionego-ustawa-losowego-systemu-przydzialu-spraw-sedziom-4\" target=\"_blank\" rel=\"noreferrer noopener\">in case U 4\/25<\/a>, in which\u00a0<a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/the-polish-constitutional-tribunal-confirms-the-regulation-of-donald-tusks-justice-minister-is-unconstitutional\/\" target=\"_blank\" rel=\"noreferrer noopener\">the unconstitutionality of a regulation partially abolishing the principle of random assignment of court cases was declared<\/a>, or in the already\u00a0<a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/third-constitutional-tribunal-ruling-in-poland-declaring-reduction-of-religious-education-unconstitutional\/\" target=\"_blank\" rel=\"noreferrer noopener\">numerous judgments declaring the unconstitutionality of restrictions imposed by the current Minister of Education on religion classes in public schools<\/a>). Thus, the Tusk government, in the name of short-term gains in the ongoing political struggle,\u00a0<strong>is actively contributing to reducing the level of protection of the constitutional rights and freedoms of Polish citizens<\/strong>.<\/p>\n\n\n\n<p>However, this is not the only negative consequence of our government adopting such a confrontational approach to politics. Perhaps even more significant\u2014and thus more reprehensible, or even disgraceful\u2014is the government applauding another consequence that would result from adopting the CJEU\u2019s position. And this consequence is&nbsp;<strong>a serious limitation of Poland\u2019s sovereignty, but also the sovereignty of the remaining member states of the European
