guarantees of judicial independence in Disciplinary Prosecutor for Judges of the Common Courts is an important position in the Polish judiciary and an important element of the system of \u201cchecks and balances\u201d within the separation of powers. Pursuant to the provisions of the&nbsp;<a href=\"https:\/\/isap.sejm.gov.pl\/isap.nsf\/DocDetails.xsp?id=WDU20010981070\" target=\"_blank\" rel=\"noreferrer noopener\">Law on the System of Common Courts<\/a>, the Disciplinary Prosecutor initiates disciplinary proceedings against judges who violate the duties incumbent upon them and acts as the prosecutor before the disciplinary court in such proceedings. Pursuant to Article 112 \u00a7 3 of the Act\u2014Law on the System of Common Courts, the Minister of Justice appoints the Disciplinary Prosecutor for Judges of the Common Courts and two deputies for a four-year term; however, no provision authorizes the Minister to remove the Prosecutor before the end of the term.<\/p>\n\n\n\n<p>Meanwhile, as early as the spring of last year, Adam Bodnar, the former Minister of Justice in Donald Tusk\u2019s government, announced&nbsp;<a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/minister-bodnar-again-attempts-dismissal-without-legal-basis\/\" target=\"_blank\" rel=\"noreferrer noopener\">the dismissal of the Disciplinary Prosecutor for Judges of the Ordinary Courts<\/a>\u2014Judge Piotr Schab\u2014after which, acting in an obviously unlawful manner,&nbsp;<a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/minister-bodnar-appointed-a-disciplinary-ombudsman-for-judges-of-courts-of-general-jurisdiction-even-though-this-position-remains-vacant\/\" target=\"_blank\" rel=\"noreferrer noopener\">he announced the appointment of Judge Mariusz Ulman to that position<\/a>. In August of last year, after Adam Bodnar had already been replaced by Waldemar \u017burek as Minister of Justice, representatives of the Ministry of Justice attempted to&nbsp;<a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/a-representative-of-the-ministry-of-justice-attempted-to-gain-access-to-the-office-of-the-disciplinary-ombudsman-for-judges-of-the-court-of-general-jurisdiction-will-the-ministry-attempt-to-force-its\/\" target=\"_blank\" rel=\"noreferrer noopener\">enter the Disciplinary Prosecutor\u2019s offices<\/a>, located in the headquarters of the National Council of the Judiciary (KRS\u2014a body which, pursuant to Article 186 of the Constitution of the Republic of Poland, safeguards the independence of courts and the independence of judges), demanding the handover of disciplinary case files. However, they were not admitted at the time, and Judge Dominik Czeszkiewicz, the director of the Ministry\u2019s Department of Administrative Supervision who took part in the attempt, insisted&nbsp;<a href=\"https:\/\/niezalezna.pl\/polska\/kto-i-jak-wszedl-do-krs-to-sedzia-czeszkiewicz-sam-to-potwierdzil-w-rozmowie-z-niezalezna-pl\/550117\" target=\"_blank\" rel=\"noreferrer noopener\">in a press interview<\/a>&nbsp;that:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>I definitely&nbsp;<strong>won\u2019t be going in with the police or a moving company<\/strong>. Let\u2019s be serious. We will take legal action.<\/em><\/p>\n<\/blockquote>\n\n\n\n<p>Shortly after that raid, Judge Mariusz Ulman, ceased posing as the Disciplinary Prosecutor, after which he&nbsp;<a href=\"https:\/\/www.rp.pl\/sady-i-trybunaly\/art43004211-mariusz-ulman-glowny-zarzut-ze-nie-wyrzucilem-z-biura-krs-poprzednich-rzecznikow#ulman\" target=\"_blank\" rel=\"noreferrer noopener\">gave a press interview<\/a>, in which he said the following:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong><em>It is not possible to circumvent or change a statute, let alone the constitution, by regulations or by de facto action<\/em><\/strong><em>. Just as some in the judicial community wanted \u2013 by&nbsp;<strong>throwing the National Council of the Judiciary out onto the street<\/strong>, since such ideas also surfaced.&nbsp;<strong>The main allegation against me was that I didn\u2019t remove the previous spokespeople from the KRS office<\/strong>. I have a somewhat different approach to the law, to the application of the law, and to the exercise of my office. That doesn\u2019t mean, of course, that it can\u2019t be done. You can go and throw it away, but that means that&nbsp;<strong>then we\u2019re breaking the law<\/strong>.<\/em><\/p>\n<\/blockquote>\n\n\n\n<p>Apparently, however, the leadership of the Ministry of Justice had a different view on the matter and decided not only to&nbsp;<strong>break the law<\/strong>&nbsp;but also to renege on its own
