already written,&nbsp;<a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/the-polish-sejm-finally-elected-constitutional-tribunal-judges-by-violating-its-own-rules\/\">on March 13, 2026, the Sejm of the Republic of Poland elected 6 people to positions as judges of the Constitutional Tribunal<\/a>. This choice raised some concerns, which were extensively discussed in a detailed&nbsp;<a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/constitutional-tribunal-appointments-in-poland-rule-of-law-implications-of-a-flawed-sejm-vote\/violating-its-own-rules\/\">analysis by the Ordo Iuris Institute<\/a>. These concerns are particularly significant given that, at the same time, before the Constitutional Tribunal,&nbsp;<a href=\"https:\/\/trybunal.gov.pl\/postepowanie-i-orzeczenia\/wokanda\/archive\/2026\/03\/17\/zasady-i-tryb-wyboru-sedziego-trybunalu-konstytucyjnego-1\">proceedings to examine whether the current procedure for appointing judges of the Constitutional Tribunal complies with the Constitution of the Republic of Poland<\/a>&nbsp;are pending.<\/p>\n\n\n\n<p>In light of the above circumstances, the President of the Republic of Poland twice\u2014on March 18 and 23\u2014raised concerns with the Speaker of the Sejm about the conduct of the entire selection procedure, requesting that they be addressed.<\/p>\n\n\n\n<p>However, the Speaker did not respond to the President\u2019s summons, but limited himself to a general statement in which he stated that&nbsp;<a href=\"https:\/\/www.sejm.gov.pl\/Sejm10.nsf\/komunikat.xsp?documentId=A9FCA877165804DEC1258DBD00552D11\">the selection was made in accordance with the law<\/a>, after which he&nbsp;<a href=\"https:\/\/www.pap.pl\/aktualnosci\/marszalek-sejmu-w-liscie-do-prezydenta-apeluje-o-podjecie-dzialan-ws-sedziow-tk\">appealed to the President<\/a>&nbsp;to take:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>immediate steps to enable the persons elected by the Sejm of the Republic of Poland on March 13, 2026, to assume office as judges of the Constitutional Tribunal in the judicial positions that had previously been vacant.<\/em><\/p>\n<\/blockquote>\n\n\n\n<p>Soon, other government officials adopted an even more confrontational stance. On March 26, 2026, Prime Minister Donald Tusk explicitly announced his intention to break the law:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>The judges will be sworn in. If the president doesn\u2019t want to be present for this, well&nbsp;<strong>then, there\u2019s nothing I can do about it. They\u2019ll be judges either way.<\/strong><\/em><\/p>\n<\/blockquote>\n\n\n\n<p>Meanwhile, President Karol Nawrocki, without waiting for the Constitutional Tribunal to issue a ruling, on April 1 unexpectedly&nbsp;<a href=\"https:\/\/www.prezydent.pl\/aktualnosci\/wydarzenia\/szef-kprp-prezydent-rp-przyjal-slubowanie-od-dwojga-sedziow-tk,118034\">invited two people elected by the Sejm\u2014Magdalena Bentkowska and Dariusz Szostek\u2014to take the oath<\/a>&nbsp;to assume office as judges of the Constitutional Tribunal. The main reason given for this decision was that, for the Constitutional Tribunal (CT) to adjudicate in full bench, in accordance with Article 37(2) of the&nbsp;<a href=\"https:\/\/isap.sejm.gov.pl\/isap.nsf\/DocDetails.xsp?id=WDU20160002072\">Act on Proceedings before the Constitutional Tribunal<\/a>, at least 11 judges are required\u2014exactly as many as the bench will comprise after two oaths are taken.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>An open declaration of lawlessness<\/strong><\/h4>\n\n\n\n<p>Meanwhile, on March 8 the media received information that the persons selected by the Sejm had allegedly sent the day before (March 7) to the President of the Republic of Poland, Karol Nawrocki, an invitation to a \u201cceremonial
