href=\"https:\/\/www.rp.pl\/sady-i-trybunaly\/art44759271-sn-uchylil-zarzadzenie-zurka-o-odsunieciu-piebiaka-od-czynnosci-sluzbowych\">overturned the order of Minister of Justice Waldemar \u017burek<\/a>\u00a0of June 15 immediately suspending from official duties Judge \u0141ukasz Piebiak, who is also a member of the NCJ. As the presiding judge, Judge Marek Siwek, stated, the order\u00a0<strong>\u201chas no justified grounds\u201d<\/strong>\u00a0and does not meet the conditions laid down in the\u00a0<a href=\"https:\/\/isap.sejm.gov.pl\/isap.nsf\/DocDetails.xsp?id=WDU20010981070\">Law on the System of Common Courts<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Let us recall the context: the order was issued just days after Judge Piebiak \u2014 elected to the Council without the backing of the ruling majority \u2014 protested against\u00a0<a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/polands-ruling-coalition-moves-to-purge-the-national-council-of-the-judiciary-of-opposition-appointed-members\/\">the political resolution of the new NCJ<\/a>, in which the Council groundlessly challenged the mandate of its own previous composition, and against the Council\u2019s endorsement of the\u00a0<a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/minister-bodnar-again-attempts-dismissal-without-legal-basis\/\">Minister\u2019s unlawful narrative about the dismissal of the Disciplinary Prosecutor, Judge Piotr Schab<\/a>. The Presidium of the NCJ \u2014\u00a0<strong>without any legal basis whatsoever<\/strong>\u00a0\u2014 also suspended the judge\u2019s access to the Council\u2019s documents.<\/p>\n\n\n\n<p
