class=\"wp-block-paragraph\">The dispute over Poland\u2019s National Council of the Judiciary (NCJ) \u2014 the constitutional body that selects candidates for judicial office \u2014 has been raging since 2017, when the then-ruling majority transferred the election of the Council\u2019s fifteen judicial members from the judges themselves to the Sejm, the lower house of Poland\u2019s parliament. The European Commission intervened forcefully against that reform, as it was recounted for the European Centre for Law and Justice (ECLJ) in \u201c<a href=\"https:\/\/eclj.org\/geopolitics\/eu\/lattaque-de-la-commission-europeenne-contre-la-reforme-de-la-justice-en-pologne--resume-chronologie-et-enjeux?lng=en\" target=\"_blank\" rel=\"noreferrer noopener\">The European Commission\u2019s Attack on the Reform of the Justice System in Poland<\/a>\u201d and \u201c<a href=\"https:\/\/eclj.org\/geopolitics\/eu\/la-reforme-du-conseil-de-la-magistrature-polonais-et-lindependance-de-la-justice?lng=en\" target=\"_blank\" rel=\"noreferrer noopener\">The Reform of the Polish Judicial Council and the Independence of the Judiciary<\/a>.\u201d The coalition governing Poland since the end of 2023 has always maintained that the mode of electing the NCJ\u2019s judicial members applied since 2018 is unconstitutional, even though Poland\u2019s Constitutional Tribunal confirmed its constitutionality in 2019. Yet this year, that same coalition had new judicial members of the NCJ elected under exactly the same procedure, claiming that everything is now in order because the parliamentary vote was preceded by judicial \u201cpre-elections.\u201d However \u2013 far fewer judges took part in those \u201cpre-elections\u201d than the government has claimed \u2014 and that it was in fact the pro-government judges\u2019 associations that picked the new NCJ members subsequently elected by the ruling coalition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p
