prosecutors before the end of their term, and the Supreme Court has almost uniformly held these dismissals ineffective. class=\"wp-block-paragraph\">In Poland, the Minister of Justice also serves as Prosecutor General. Since 2024, the government of Donald Tusk has sought to take control of the disciplinary system for judges. Its main obstacle has been the <strong>Disciplinary Prosecutor for Judges of the Common Courts<\/strong> and his two deputies, appointed in 2022 for a <strong>fixed four-year term<\/strong>. Ministers Adam Bodnar and Waldemar \u017burek simply <a href=\"https:\/\/obserwator-praworzadnosci.pl\/en\/the-ministry-is-clinging-to-its-own-narrative-about-the-possibility-of-dismissing-disciplinary-spokespeople-despite-the-lack-of-legal-grounds-a-bizarre-letter-to-court-presidents\/\" target=\"_blank\" rel=\"noreferrer noopener\">announced their \u201cdismissal\u201d in 2025<\/a>, even though no statute grants them such a power \u2013 and the Supreme Court refused to recognize it. Now the prosecutors subordinate to \u017burek have gone a step further: they accuse the three judges of <strong>impersonating the very office they lawfully held<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On October 9, 2026, the National Prosecutor\u2019s Office <a href=\"https:\/\/www.gov.pl\/web\/prokuratura-krajowa\/wnioski-o-uchylenie-immunitetow-trzech-sedziow-sadu-apelacyjnego-w-warszawie\" target=\"_blank\" rel=\"noreferrer noopener\">asked the Supreme Court<\/a> for permission to hold judges Piotr Schab, Przemys\u0142aw Radzik and Micha\u0142 Lasota criminally liable. The core charge is <strong>exceeding their authority by<\/strong> <strong><em>posing<\/em><\/strong> <strong>as the Disciplinary Prosecutor or his deputy<\/strong> <strong><em>despite their dismissal<\/em><\/strong> <strong>by the Minister of Justice<\/strong> (Art. 227 in conjunction with Art. 231(1) of the <a href=\"https:\/\/isap.sejm.gov.pl\/isap.nsf\/DocDetails.xsp?id=WDU19970880553\">Criminal Code<\/a>).<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">One cannot impersonate an office from which no one has lawfully been removed<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">As we have pointed out thirteen times already (!), Art. 112(3) of the <a href=\"https:\/\/isap.sejm.gov.pl\/isap.nsf\/DocDetails.xsp?id=WDU20010981070\" target=\"_blank\" rel=\"noreferrer noopener\">Law on the System of Common Courts<\/a> provides that the Minister appoints the Disciplinary Prosecutor and his deputies \u201cfor a four-year term\u201d, but it does not provide for their dismissal before the term expires. Art. 7 of the Polish Constitution leaves no doubt:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><em>The organs of public authority shall function <strong>on the basis of, and within the limits of, the law<\/strong>.<\/em><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">It follows \u2013 as Poland\u2019s Constitutional Tribunal held as early as its <a href=\"https:\/\/ipo.trybunal.gov.pl\/ipo\/view\/sprawa.xhtml?pokaz=dokumenty&amp;sygnatura=W%207\/94\" target=\"_blank\" rel=\"noreferrer noopener\">resolution of May 10, 1994 (ref. W 7\/94)<\/a>, issued after President Lech Wa\u0142\u0119sa had removed the head of the National Broadcasting Council without any power to do so \u2013 that <strong>the competences of public authorities cannot be presumed<\/strong>. The Supreme Court recalled this principle in its decision of December 8, 2025 (ref. II ZOW 80\/22) and confirmed the unlawfulness of the dismissals in at least five other rulings in 2025.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Since the dismissals were unlawful, <strong>it is rather Ministers Adam Bodnar and Waldemar \u017burek who should answer under Art. 231 of the Criminal Code for exceeding their authority by acting without a legal basis.<\/strong><\/p>\n\n\n\n<p
