According to data from the German Federal Police and the Polish Border Guard, from the beginning of 2024 to mid-2025, Germany returned over 10,000 migrants to Poland. Data from Poland’s Oder River Border Guard Division indicates that nearly 80% of migrants transferred in 2024 and 2025 from Germany to the Oder River Border Guard Division had no documents. In other words, the Polish government has no idea who it is letting into the country through the western border. On the other hand, it engages its services in… persecuting citizens who devote their own resources and time to protecting Polish borders. Government repression also affects ordinary, concerned Poles – including women like 20-year-old Oliwia from Zamość.
3 years in prison for fearing for his own safety….
At one of the rallies against mass migration that took place in 80 towns and cities across Poland on July 19, Oliwia, a 20-year-old mother of a six-month-old boy and a physiotherapy student, spoke out. In a speech filled with emotion, fear, and trepidation, she expressed fear for her safety and the fate of her 6-month-old baby. The young woman objected in strong words to the mass migration to Poland of people from countries where “women are treated like garbage, where rape is common, where a woman who goes out alone in the evening is seen as simply asking to be raped.”
Ms. Olivia’s emotions were all the greater because she comes from the vicinity of Toruń, a city where a few weeks earlier an immigrant from Venezuela beat a 24-year-old woman in a bestial manner, inflicting numerous stab and cut wounds to her face, head, and chest that led to her death two weeks later. During the Zamość demonstration, Oliwia said outright that she could have been in the place of murdered Klaudia…
Although Oliwia did not incite to commit any crime, and the picket was peaceful in nature, the Zamość District Prosecutor’s Office considered the woman’s statement to be a manifestation of public incitement to hatred based on racial and religious differences and opened an investigation into the case. The case is being investigated for committing a crime under Article 256 of the Polish Criminal Code, which provides for a penalty of up to 3 years in prison for this “incitement to hatred.”
Probably the reason for the investigation of Oliwia’s speech is that the young mother used the word “Murzyni” in her speech, which in Polish is the word for Black people. (Editor’s note: “Murzyn” is often translated as “negro” in English, but in Polish the word does not carry the same strongly harmful or racist connotations as its English counterpart, and it remains the most commonly used term for referring to Black people. Only in recent years have some, usually on the left of the political divide, begun to question its use, while most Poles still do not regard it as offensive.) For this, she was attacked by exactly the same circles that not so long ago openly supported aggressive pro-abortion demonstrations, where we could hear the worst vulgarities even from the mouths of later ministers of the Donald Tusk government… The participants of those vulgar protests remain unpunished to this day, and for using the word “Murzyni” the young mother is to go to jail?!

Ordo Iuris on the side of citizen border patrols
We must win this case. But this is only a small part of the activities undertaken by Ordo Iuris experts.
In an effort to help all Poles who, out of concern for our collective security, have organized from the bottom up and taken action to defend the western border socially, we have published a legal guide for citizens defending the Polish borders, which discusses how Poles can respond to attempts by migrants to illegally cross the border. In doing so, we emphasize that during a civil detention, physical force may be used only to the extent necessary to actually detain a person and hand that person over to the Border Guard or the Police.
The publication also explains how the government’s recognition of facilities on the border as critical infrastructure affects the capabilities of citizens to defend the border.
We also defend uniformed border defenders
However, our support is needed today not only by people, harassed for participating in demonstrations or civilian defenders of the borders. Indeed, the prosecutor’s office is also prosecuting… soldiers who risk their lives defending the Polish-Belarusian border against hybrid aggression.
On the night of July 10-11, a group of aggressive migrants tried to cross the Polish-Belarusian border. One of them severely attacked a Polish soldier, causing severe swelling around his eye and vision problems. The soldier stopped the immigrant, hitting him with the butt of his rifle. The prosecutor’s office concluded that the culprit of the incident was… the Polish soldier, and initially opened only an investigation into the beating of the illegal immigrant! The Ordo Iuris Institute has now filed a notice of possible misconduct by the prosecutor.
Other proceedings complete this picture of turning the world on its head. At the second-instance stage, we join in the proceedings concerning two Afghans who illegally crossed the Polish-Belarusian border in 2021, and who were each awarded PLN 5,000 in compensation by the first-instance court for… Being detained by the Polish Border Guard. I hope that with the support of Donors and Friends of Ordo Iuris, we will bring about a change in the judgment of the court of first instance.

Our publication puts the safety of the defenders of our borders first, rather than the comfort of newcomers seeking to illegally enter on Polish territory. The publication analyzes the situations in which officers defending the border have the right to use direct coercive measures and fire their service firearms. We emphasize that soldiers, border guards, and police officers serving on the border are obligated to turn back all foreigners attempting to cross the border illegally.
The CJEU weakens nations’ right to defend their borders
At the beginning of August, the Court of Justice of the European Union issued two very alarming and dangerous rulings regarding immigration issues.
In the first instance, the CJEU judges dealt with the case of migrants from Bangladesh who were denied asylum because their country was deemed to provide an adequate level of protection (‘safe country of origin’). The migrants did not agree with this decision and the case ultimately went to the CJEU, which, responding to the preliminary questions of the Italian court, stated that a country can only be considered a ‘safe country of origin’ if it provides adequate protection to all residents. Adopting such an assumption will significantly hinder the deportation of migrants from European countries, because after all, in every third country there will be someone who may not feel sufficiently safe…
The second of the mentioned rulings concerned two asylum seekers with citizenship from Afghanistan and India, whom the Irish authorities did not provide accommodation, citing a lack of available spaces in the reception centers. In response to a preliminary question from an Irish court, the CJEU ruled that member states are obliged to provide material support to persons seeking international protection and that they cannot invoke limitations of their own resources. Both of these judgments genuinely limit Poland’s sovereignty in terms of conducting its own independent migration policy.
What does the Migration Pact mean for Poland?
Our sovereignty in the area of migration policy is most strongly impacted by the EU’s “migration pact,” discussed in the report by Ordo Iuris concerning regulations that are set to come into effect in 2026!
Poland can still avoid the fate of Western European countries that have opened up to mass immigration, which has negatively impacted their security. We don’t have to repeat the mistakes of Germany, France, the United Kingdom, Belgium, the Netherlands, or Spain. We can follow our own path, preserving the cultural integrity of our Homeland and the safety of its citizens.
Lawyers from Ordo Iuris had already warned many months ago about the dangers associated with the Migration Pact in the report “Migration Pact and the protection of the Polish border in questions and answers”, in which we provided answers to 26 of the most important and frequently asked questions about the Migration Pact. It indicates that the Migration Pact regulates many areas, consisting of 10 separate legal acts. For non-compliance with any of them, EU countries can be fined by the Court of Justice of the European Union.
Together we will defend Poland against mass migration
As a nation, we have been accustomed for many years to living in a safe country. Walking down the street, we do not have to fear that we will be attacked by aggressive assailants. The mass migration of people from foreign countries, some of whom not only disrespect but hate our civilization and its values, radically worsens the situation of Poles, weakening their security.
