litigation

The Litigation Program of the Ordo Iuris Institute for Legal Culture was established to exert an active and professional influence on judicial and administrative jurisprudence in cases involving the defense of the family and the freedoms of conscience and speech of those who are socially excluded because of their value system. The ideas that the Ordo Iuris Institute defends in all its academic and analytical activities find both their justification and application in the Litigation Program.

Advocates, legal advisers, and trainees from across Poland who cooperate with the Ordo Iuris Institute represent the beneficiaries of the Litigation Program in civil, criminal, family, misdemeanor, labor, and administrative court cases. In their work, they come into direct contact with families and individuals harmed or attacked because of their traditional values, even though those values are affirmed in the Polish Constitution.

The lawyers of the Ordo Iuris Institute act in defense of the principle of subsidiarity, which serves as a barrier against state interference in the autonomy of family life. Through our efforts, children who were removed from their parents due to low material status or malicious accusations are returned home. We provide support to doctors, pharmacists, nurses, and midwives experiencing difficulties in practicing their profession according to their best knowledge and conscience. We act as advocates for freedom of speech and assembly, defending pro-life activists persecuted for their publicly expressed views. We use all legally available means to ensure that those responsible for injustices committed in the name of harmful ideologies face the consequences of their actions.

We appear in proceedings before the Constitutional Court in cases where enacted laws do not comply with the constitutional order of the Republic of Poland.

Within the framework of the Litigation Program, we train volunteers, young students, and lawyers from various parts of the country who, through their involvement in the Program and direct work with those in need of our support, gain valuable experience necessary for conducting the challenging defense of the existing social order and legal culture in judicial and administrative proceedings.

Thanks to our commitment, and with the support of volunteers and donors from all over Poland, we participate in precedent-setting cases that shape favorable lines of jurisprudence on the most socially significant issues.
