The authors of the publication have analyzed the most significant violations of rule-of-law principles in Poland, and they present proposals for concrete remedial measures.

The report addresses issues such as undermining the status of the National Council of the Judiciary, the failure to publish Constitutional Tribunal judgments, the takeover of the National Prosecutor’s Office, the unlawful issuance of abortion guidelines, the takeover of public media, and the violation of freedom of conscience and religion in education.
The report Finding a Way Out of Poland’s Rule-of-Law Crisis – Possible Courses of Action and Reform, prepared by the Ordo Iuris Institute, has been delivered to the President of the Republic of Poland, Karol Nawrocki. The publication identifies the key areas of legal violations for which the EU-backed government of Donald Tusk is responsible. The authors also draw attention to possible measures to remedy the situation in the best interest of all Poles. The report presents problems related to the status and functioning of the National Council of the Judiciary and the practice of dismissing the administrators of courts in violation of the law. The publication also addresses issues related to the performance of duties by disciplinary officers and judges’ disciplinary committees. The authors also address issues related to the non-publication by the government of Donald Tusk of the Constitutional Tribunal’s rulings and the issue of the unlawful takeover of the National Prosecutor’s Office. The report also addresses the issuing of unlawful abortion guidelines by the government, violations of freedom and conscience in education, and the takeover of public media.
The publication presents specific directions for change in legal and institutional regulations. The existing constitutional and legal crisis deepens citizens’ distrust of the state and the law it enacts, thereby weakening its security. The authors agree that constructive legal reforms will restore the state’s authority among citizens and set clear limits on interference with civil liberties.
This report is part of a series of analyses on the state of the rule of law in Poland previously undertaken by the Ordo Iuris Institute. To date, reports including A Year of Devastation of the Rule of Law in Poland and Violations of the Democratic State of Law and the Rule of Law by the Government of Donald Tusk after December 13, 2023 have been published. The Rule of Law Observer website also reports on cases of violations of the rule of law.
