On November 3, 2026, eight persons, five of whom have never taken the oath before the President of the Republic, gathered at a “General Assembly of the Judges of the Constitutional Tribunal (CT)” convened by Anna Korwin-Piotrowska. As we already pointed out on Monday, a meeting convened by an unauthorized person and in breach of procedure could not produce any legal effects.

Our predictions regarding the quorum have been confirmed. Those gathered “calculated” it on the basis of twelve judges, even though the statute requires it to be computed as two-thirds of the total number of the Tribunal’s judges, which the Constitution sets at fifteen.

Any disciplinary action against the President of the CT and his deputy is fundamentally invalid. Not only were the disciplinary panels drawn in a defective manner, but in both of them unauthorized persons also form the majority.

On November 3, 2026, at the seat of Poland’s Constitutional Tribunal (CT), a meeting was held that its participants called the General Assembly of the Judges of the CT. It was convened by Anna Korwin-Piotrowska, who since October 30 has been presenting herself as the person standing in for the President of the Tribunal. Eight persons took part in it: Magdalena Bentkowska, Dariusz Szostek and Sławomir Patyra, who have taken the oath before the President of the Republic, as well as Krystian Markiewicz, Maciej Taborowski, Marcin Dziurda, Maciej Berek and Anna Korwin-Piotrowska herself – that is, five persons who have never taken such an oath. Those gathered adopted the draft CT budget for 2027, decided that the quorum was eight persons, and drew lots to select the members of the disciplinary courts and the disciplinary prosecutors in the cases of the President of the CT, Bogdan Święczkowski, and the Vice-President of the CT, Bartłomiej Sochański.
At the outset, it must be clearly emphasized that, as we pointed out on Monday, the “Assembly” was invalid from the very moment it was convened. It was convened by a person who is not a judge of the CT and who, therefore, all the more cannot stand in for the President of the Tribunal. Moreover, she did so in breach of the statutory deadline and form of notification, and she admitted to the meeting persons who are not members of the Assembly.
