The authors of the resolution consider abortion to be a human right and regard the denial of access to “safe abortion services” as gender-based violence, even though this position is absurd from the point of view of international law and disregards the right to life.
The Ordo Iuris Institute recommends that the Committee on the Rights of Persons with Disabilities explicitly condemn the practice of eugenic abortion and promote a policy that ensures equal treatment and the protection of the right to life for all persons, regardless of health status or disability.
Conditioning the awarding of EU funds on compliance with a rule-of-law assessment by the European Commission creates a risk of EU institutions exerting undue influence on member states, including Poland.
The Ordo Iuris Institute draws attention to abuses related to the redefinition of the concept of “gender,” instances of violations of family integrity, and pressure exerted on countries regarding abortion.
The Ordo Iuris memorandum aimed to draw attention to the potential effects of financial mechanisms on the sovereignty of EU member states and to issues concerning the protection of life.
Interference also takes more subtle forms. Sometimes it is not an aggressive attack, but a selective blindness—a refusal to acknowledge obvious violations of the rule of law when they are committed by governments favored by Brussels. A refusal to defend the democratic rights of the opposition or to safeguard media pluralism when the violators happen to be liberal forces aligned with the European establishment.
The amendments provide, among other things, for the protection of sovereignty in matters of national identity (family, marriage, education), a ban on surrogacy, confirmation of the biological definition of sex, and the recognition of only a woman and a man as parents.
The question about gender has more than three response options. In subsequent questions, children are asked, among other things, to indicate whether they belong to the “LGBTIQ+ group.”
Instead of scrapping an ill-conceived school subject that has been poorly received by parents, Poland’s deputy education minister is now accusing children and parents’ rights advocates of “disinformation” and has announced that, in the future, the new “health education” curriculum with comprehensive sex ed may be mandatory.
For years, lawyers from the Ordo Iuris Institute have consistently and firmly pointed out that there is no “right to abortion” in either Polish law or international law binding on Poland. Unlike the “right to life,” which is the foundation of the human rights system and also applies to unborn life.
Ordo Iuris’s positions emphasized the role of the family as a social and legal foundation, identified threats arising from the ideological redefinition of human rights, and called for the defense of natural law as the basis of the international order.
Financing abortion using EU funds would constitute interference in national constitutional orders, including the Polish Constitution.
